From: The People's Courts News and Communication Agency Qiao Wenxin Updated: 2019-05-22On the morning of May 22, the Sino-French Symposium on International Commercial Trial "the Symposium" ) was held in Beijing. Luo Dongchuan, the Vice President of the Supreme People's Court of China( "the SPC" ) and Thomas Andrieu, the Director of Civil Affairs and Seals Directorate of Ministry of Justice of France attended and delivered speeches.
Luo Dongchuan welcomed the French delegation to the Symposium on behalf of the SPC and Zhou Qiang, the President of the SPC, and pointed out that China and France had a long-lasting friendship. He said that recent years have witnessed a positive development of the communication and collaboration between the judicial authorities of the two countries. The Symposium embodies the spirits of the Joint Declaration between the People's Republic of China and the French Republic, and the Memorandum Between the Supreme People's Court of China and the Court of Cassation of France, and improves judicial communication and collaboration between the two countries. The Symposium will surely further consolidate and enhance judicial exchanges and cooperation between China and France.
Luo Dongchuan stated that China's international commercial trial is an integral part of the global international commercial dispute resolution mechanism. The establishment of the China International Commercial Court of the SPC( "the CICC" ) is a major reform measure made by the CPC Central Committee with general secretary Xi Jinping at the core, and is also of great significance to the people's courts to perform their duties and serve the "Belt and Road Initiative". The CICC has made useful explorations already, including setting up an "one-stop" platform for diversified international commercial dispute resolution, establishing International Commercial Expert Committee ( "the Expert Committee" ), innovating the trial system to ensure judicial transparency. The CICC wishes to enhance cooperation on institutional construction with the Paris Commercial Court and the International Chamber of the Court of Appeal of Paris and other international commercial courts to further improve its work. The international commercial judges of the two countries should strengthen communication and broaden consensus, working jointly towards a fair, efficient, convenient and low-cost trial for international commercial cases.
Thomas Andrieu expressed his gratitude to the SPC for the invitation and gave high praise for the achievements of the Chinese courts in judicial reform. He stated that the international commercial trial is both a traditional and novel topic. In the context of globalization, rapid growth of international trade and increasingly complex international political landscape have posed new challenges to international commercial dispute resolution. He wishes that, through this Symposium, the international commercial judges from the two countries can exchange their experience and deepen communication and cooperation, jointly contributing to the system-building and rule-making of international commercial dispute resolution.
Participants of the Symposium gave introductions about the commercial courts in China and France respectively and had discussions on case management, recognition and enforcement of foreign judgements, and challenges faced by the judges of the international commercial courts.
Participants of the Symposium include judge representatives from the Paris Commercial Court and the International Chamber of the Court of Appeal of Paris, lawyer representatives from the Paris Bar, judge representatives from the CICC, representatives from the Expert Committee, representatives from the arbitration and mediation institutions selected into the CICC "one-stop" dispute resolution platform and judge representatives responsible for foreign-related commercial cases and maritime cases from the people's courts at different levels.
On the afternoon of May 22, Luo Dongchuan met with the French delegation to the Symposium. Heads of relevant departments of the SPC attended the meeting.
